While hearing the appeal, the Single Bench of Justice Arvind Kumar Mishra observed, “In view of the fact that more than 10 cases are stated to be pending before the Civil Court and there must be 25 more cases which can be said to be pending and that It can be said that the matter is of fundamental public importance and has affected people cutting across communities and the case has not moved an inch on merits for the last two to three years since the filing of the case. This fully justifies transfer of all the connected cases from the concerned Civil Court to this Court under Section 24(1)(b) of the CPC.”

The transfer petition, filed through Advocates Hari Shankar Jain, Vishnu Shankar Jain, Prabhash Pandey and Pradeep Kumar Sharma, stated that the issues involved in the matter pertain to crores of devotees of Lord Krishna. This matter is of national importance. That’s why all the cases should be transferred for trial in one court only.
